I think it is VERY interesting that it has taken THIS long for Mumia to get to the Third Circuit. I believe it is, not just because of the lack of evidence, but the ILLEGALLITY in the fact that MANY if not MOST of Mumia’s records are not locatable, documented or certified. In essence, a court can do WHATEVER it sees fit with cooperation of those in the mix. ESPECIALLY if they KNOW the paperwork is NOT real. I challenge anyone to look online and find Mumia's case in PACER. It can ONLY be located in WESTLAW and is cited as an ED file. There is no REAL case number. I think if we look at the HOW and not just the WHY Mumia would be free TOMMORROW. USE the UNITES STATES FREEDOM OF INFORMATION REQUEST SHOWS NO STATE COURT RECORDS OR APPEALS for Mumia.
FYI: I only know this to be fact. My brother was tried in a high profile media case that involved Rendell, Lynne Abraham, Westlaw and PACER. The case received NATIONAL media attention. In digging through the case, I came to find that a Federal Habeas had been DENIED in regards to my brother. Mumia was cited in this instance as a REASON for denial from Magistrate Judge in Pennsylvania. Upon request of both the habeas petition and cases cited to deny the habeas, I found that the case and the charge used to deny my brothers appeal, is NOT certified and does not exist LEGALLY!
The Issue: Mumia is being used to deny litigants their habeas rights. These cases in which Mumia was used can NOT be found by DOJ, NOR have I been able to get copies (of what should be public record), of the Mumia citing that was used against my brother to deny his habeas. Upon informing the Third Circuit Court, PA Attorney General, I also informed the USPS in regards to postal fraud. These “denials” using Mumia against my brother were mailed to DENY my brothers rights AND were not CERTIFIED, filed or REAL. DOJ letter, US District Court and US Executive Attorney did a search and in writing stated, NO RECORDS. For these reasons, my brothers’ case after 12 long years was REDACTED in regards to conviction and prosecution. The Judge involved has been served! ...What can be done for Mumia? I would sure like to give my two cents
